LIHUE — After a week-long trial, a jury found a Hanapepe man guilty of second-degree assault on Friday in 5th Circuit Court.
Gregg Tebo Booth, 65, was found guilty on one count of second-degree assault for using a sledge hammer to injure Kaulana Kaneakua on Dec. 5, 2012. The jury found Booth not guilty of a second assault charge.
According to a county press release, Booth and Kaneakua, a co-worker at Kauai Nursery and Landscaping, were arguing over exhaust fumes caused by a truck Kaneakua left running in front of Booth’s workplace.
The argument escalated and Booth struck Kaneakua in the forehead and fractured his sinus.
Booth was arrested on two charges of second-degree assault.
He was also accused of making terroristic threats and interfering with the report of an emergency.
Judge Kathleen Watanabe ordered a pre-sentencing diagnostic report for the defendant and scheduled sentencing for April 9, 2014.
