LIHU‘E — A Koloa man’s preliminary court hearing was delayed because of a potential conflict of interest Friday in Fifth Circuit Court in Lihu‘e.
Court-appointed defense attorney Mark Zenger expressed his concerns at the briefing.
Tyrone Strong McCarthy II, who faces charges of burglary of a dwelling during an emergency period, unauthorized control of a vehicle and theft in the fourth degree, had his preliminary hearing moved to Sept. 11.
McCarthy’s other charges include criminal property damage and third-degree assault, according to the complaint filed by the court.
Zenger expressed concerns to the presiding Judge Joe Moss Friday afternoon, saying he had defended some of the alleged victims named on the complaint against McCarthy in the past.
The mutual agreement between all parties involved prompted Moss to assign court-appointed attorney Shauna Cahill to defend McCarthy at the Sept. 11 hearing.
McCarthy’s bail remains at $140,000.
