LIHUE — The liquor license transfer process to Mariachi’s Authentic Mexican Restaurant from the former owner will be delayed.
The now defunct Kapaa Cafe is scheduled to respond to two liquor license violation, but is expected to request a continuance, according to Gerald Rapozo, director of the Kauai Liquor Control Commission.
Mariachi’s is open for business but the owners are waiting for the transfer of the liquor license. In the meantime, guests are allowed to bring their own beer or wine.
The violations do not pertain to the application but could be a factor in the transfer, Rapozo said, as the current licensee, Kapaa Cafe, must submit a sales report to determine the percentage fee still owed to the county.
“Mariachi’s is not responsible for the violations,” Rapozo said.
Kapaa Cafe was open for a short time in late 2013. The Liquor Commission assessed them with three counts of violating Rule 7.8(a), which requires a manager on duty to be not less than 21 years-old, licensed and approved by the commission to be in charge of the premises at any time there are people other than employees on the premises.
The cafe was also assessed with three counts of violating Rule 7.10, which requires a licensee to show a record of all bar employees and management on duty.
Punishment for offenses range from letters of reprimand to a $2,000 fine or the suspension or revocation of the license.
Representatives from Kapaa Cafe could not be reached.
