LIHUE — Three indictments involving murder, attempted murder and negligent homicide came down in January in 5th Circuit Court.
Robert Wayne Yount, 83, of Kalaheo, is charged with attempted first-degree murder and four counts of first-degree terroristic threatening in connection to a Nov. 19, 2013, incident in which he allegedly threatened Kauai Police officers Jason Overmyer and Vernon Scribner, who were attempting to serve a warrant on a separate indictment.
Yount is accused of threatening officers with a semi-automatic firearm, a felony, and misdemeanor possession of prohibited ammunition.
Yount is charged with four counts of failing to acquire a permit to own a firearm, to include a 9mm semi-automatic handgun, a 16 gauge shotgun, a 30-06 rifle, and a .22 caliber rifle. He is also charges with carrying or using a firearm in the commission of a separate felony.
Yount reportedly fired a single shot in the direction of an officer before barricading himself in a room. He was arrested without further incident after a 30 minute stand-off.
The officers were attempting to serve Yount with a grand jury indictment for a charge of first-degree negligent homicide in the March 16, 2013, death of Jill Garnett, 26, of Waimea, who was struck by a vehicle while walking along Kaumualii Highway in Puhi.
Yount is being held at Kauai Community Correctional Center. He has not yet been arraigned.
• Brittney L. Kane is charged with manslaughter, first-degree negligent homicide, second-degree assault, and first-degree negligent injury from operating a vehicle while reportedly intoxicated after leaving an underage drinking party on Sept. 11, 2011.
Kane, who was 16 at the time, is charged with causing the death of passengers Nahele Kapua, and causing serious bodily injury to Koahe Cordeiro by operating a vehicle in a negligent manner while under the influence of drugs or alcohol.
The vehicle went off the side of Kuhio Highway, struck a tree and flipped over. Nahele suffered fatal injuries from the single-vehicle accident.
Kane has not yet been arraigned.
• Kyle Matthew Welch, 27, of Princeville, was charged with attempted second-degree murder and first-degree terroristic threatening. He is accused of the Jan. 9 beating and attempted death of Jeremy Alderson, 42, of Kapaa, and for threatening to cause bodily injury to Jesse Reynolds with the use of a machete.
Welch was arraigned Jan. 16 and his trial date was set for April 21. He is being held at KCCC with bail set at $750,000.
