The delivery company claims Kauai Fruit and Flower Co. owes $34,526.82 for unpaid deliveries.
The firm’s store is located on Kuhio Highway north of Hanama‘ulu.
The delivery company is alleging that since Dec. 19, 2003, Kauai Fruit & Flower Co. had failed to pay Federal Express “for all charges and costs incurred for shipping (the) defendants items,” according to the suit.
The suit was filed in the Fifth Circuit Court in Lihu‘e July 13. The suit names the company only and does not identify any Kauai Fruit & Flower Co. official or owner by name within the context of the suit. The defendants are referred to as “Does.”
The suit seeks the amount owed as of July 26, 2004 plus prejudgment issues and interest on the monies allegedly owed.
The suit alleges that between Jan. 26, 2004 and Aug 16, 2004, 19 checks in amounts ranging from $2,698.27 to $73.99 were returned by the bank marked unpaid due to insufficient funds in the account.
But one of the exhibits, a letter written by Jay T. Suemori, attorney for the plaintiff, dated Aug 3, 2004 was addressed to Pamela Smith-Chock to inform her that as of July 19, 2004 the company demanded payment for the full amount due.
Kauai Fruit & Flower Co. Inc. officials said last week they had no comment on the matter.
That Aug. 3 2004 letter, sent by certified mail with return receipt requested, demanded payment in full and gave Kauai Fruit & Flower Co. Inc. 30 days to pay or face legal action Suemori said the suit was “self-explanatory.”
