LIHUE – A bill relating to additional dwelling units (ADU), recently passed by the Kauai County Council, was signed into law by Mayor Bernard Carvalho, Jr.
The new law, Ordinance 981, extends the deadline for obtaining a building permit from Dec. 15, 2014, to Dec. 15, 2024, for property owners that obtained an ADU facilities clearance form before June 16, 2007.
Further, qualified landowners with valid building permits who have not reached substantial construction on their ADUs, as well as those that intend to re-submit their building plans but have expired building permits, are required to seek re-certification by close of the business day on Feb. 17, 2015.
In addition, a fee of $250 must be submitted with the application. Property owners that have already constructed their ADUs do not need to apply for re-certification.
The certification forms and affidavits are available at the Planning Department counter at the Lihue Civic Center, Kapule Building and on their website, www.kauai.gov/planning.
