LIHUE — The fate of two transient vacation rentals operating in Kekaha will not be decided until June.
During a Planning Commission Tuesday, commissioners unanimously voted to defer taking action on two TVRs to give the operators, Ian and Anna Cronshaw, time to argue their case.
Because the Cronshaws did not renew their Nonconforming Use Certificates, the Planning Department issued a cease and desist order on both homes in 2013, according to a release.
Two years later, the Cronshaws filed an appeal, and went into a contested case hearing.
On May 11, a hearings officer recommended that the Planning Commission rule in favor of revoking the permit, and shut down both TVR locations, the release said.
The officer also recommended that the Cronshaws pay a $10,000 fine.
On Tuesday, the Planning Commission was expected to make a decision regarding the Kekaha TVRs. But the Cronshaws did not attend the meeting, so Jodi Higuchi-Sayegusa, first deputy county attorney, suggested action be deferred.
It’s required by law to give both parties in a contested case hearing at least 14 days to present their case to the planning commission, she said.
Mike Dahilig, planning director, approved of the action.
The planning commission is expected to make a decision regarding the TVRs on June 28.
