LIHU‘E — A Koloa man chose not to take a plea agreement on Tuesday morning in Fifth Circuit Court on the eight charges he is facing.
Tyrone McCarthy II, 35, is currently facing eight charges, and has stated on the record he does not wish to accept the state’s current plea agreement.
McCarthy chose not to take the agreement against the advise of his public defender Shauna Cahill.
According to court documents, McCarthy is facing eight charges including terroristic threatening in the first degree, kidnapping, two counts of burglary during an emergency period, theft of a motor vehicle, theft in the fourth degree, criminal damage to property and assault in the third degree.
Court documents state that on Aug. 30, 2020, McCarthy allegedly attempted to kidnap a local man. During the alleged attempt to kidnap his victim, McCarthy allegedly verbally threatened the victim.
Court documents also state McCarthy allegedly threatened to do bodily harm to his victim during his attempt to kidnap him.
McCarthy proceeded to enter the victim’s home and attempted to steal the victim’s vehicle, according to court documents.
The documents further state that he did damage to the victim’s home and injured the victim during the attempted kidnapping.
McCarthy is being held at the Kaua‘i Community Correctional Facility on $100,000 bail.
A jury trial is scheduled for May 10.
