shooting in which one man died and another survived with a turn of his head,
remained in Kaua`i Community Correctional Center Tuesday in lieu of $500,000
bail.
Giddens was expected to be arraigned today or Thursday, said Kaua`i
County Prosecuting Attorney Mike Soong.
Kaua’i Police were scheduled to
give their report on the shootings to prosecutors this morning, after which
formal charges would likely be filed. Authorities were still discussing
yesterday what crimes would be formally alleged.
Soong said neither Giddens
nor his alleged victim, 42-year-old Colan Fernandes, also of Hanamaulu, had
prior criminal records.
Fernandes was found dead inside a house at 4286
Ho`ohana St. Giddens barricaded himself in the home where Fernandes lived with
his mother and brother.
Giddens was talked out of the house by two Kaua`i
Police after less than an hour.
Authorities said that before surrendering,
Giddens called a police dispatcher and wanted assurances that if he voluntarily
came out of the house, he wouldn’t be shot.
He surrendered without
incident.
King Kaumuali’i Elementary School, located two blocks away, was
locked down until the situation was resolved.
Giddens allegedly shot
another man at Hanamaulu Beach Park before going to the Fernandes home. That
victim, 49, remained Tuesday at Wilcox Memorial Hospital, where his condition
was upgraded from guarded to fair.
Police said the man shot at the park
turned his head just as a shot was fired, evidently saving himself from a fatal
wound.
The type of firearm has not been disclosed. Sources said it was not
a handgun, however.
Residents in the subdivision of small, older tract
houses where Giddens eventually surrendered told reporters that Giddens fired
shots at houses and cars and yelled profanities before police surrounded the
house where he was barricaded and brought the violent outburst to a peaceful
conclusion.
Detectives, line officers and other law enforcement personnel
remained on Ho`ohana Street most of Monday, talking to neighbors, sifting
through evidence and trying to piece together the facts behind Giddens’
apparent rampage.
Five years ago, in the same subdivision, Janice Noblisse,
24, shot her live-in boyfriend, Milan Cabacungan, 39, with an AK-47 – an
assault rifle – then killed their two small children before turning the gun on
herself.
