Edward Alapai, Jr., 23, who is currently serving a 10-year term for burglary, was sentenced recently by Fifth Circuit Court Chief Judge George M. Masuoka to a total maximum of five additional years in prison for unrelated burglary, theft, harassment and resisting-arrest charges, according to county prosecutors in a press release.
Alapai entered his guilty pleas in November to charges he broke into and stole items from the Kapa‘a Ace Hardware store, and at another time stole jewelry, cash and other personal property of two elderly women, prosecutors said. He also challenged two younger Kaua‘i women to fight, and resisted arrest when Kaua‘i Police Department officers tried to subdue him, prosecutors said.
In other court action:
• Brian Perreira, 31, of Kalaheo, was sentenced by Masuoka to a total maximum of five years in prison for promoting a detrimental drug (marijuana) and drug paraphernalia, prosecutors said. He pleaded guilty in October, after being arrested at a Kalaheo residence on bench warrants related to probation violations and failure to attend court-ordered, anti-domestic-violence classes.
Police searched Perreira and recovered a marijuana smoking pipe, a plastic bag containing marijuana, and a plastic bag containing methamphetamine residue, prosecutors said.
• Chad Fabian Bond, 34, of Kilauea, was re-sentenced to five years in prison by Masuoka after being found in violation of the terms and conditions of his probation for two counts of terroristic threatening and one count of criminal property damage, for incidents occurring in 2000 and involving him being the subject of a KPD high-speed chase and ramming a police vehicle, prosecutors said.
Bond pleaded no contest to the three felony offenses and numerous misdemeanors and petty misdemeanors in 2001, and was given probation the same year.
A motion to revoke Bond’s probation was filed by prosecutors in November 2005, after Bond’s probation officer reported that Bond left Kaua‘i without prior approval of his probation officer, failed to appear at meetings with his probation officer as ordered, moved from his approved address without informing his probation officer, was discharged from his drug-treatment program due to excessive absences, and failed to pay a court-ordered fine and fees.
• Guy Akau, 44, of Lihu‘e, was re-sentenced by Masuoka to five years in prison after being found in violation of the terms and conditions of his probation for sexual assault, according to prosecutors.
Akau committed and was indicted for the felony offense in 2001, and was found guilty of the felony after a jury-waived trial in 2002. Akau was placed on probation, with special conditions including serving one year in jail, in 2002.
A motion to revoke Akau’s probation was filed by prosecutors last month, after Akau’s probation officer reported that Akau left Kaua‘i without permission from his probation officer, failed to check in with his probation officer upon returning to Kaua‘i, and continued to consume alcohol while on probation, in violation of orders of his probation, prosecutors explained.
