LIHU‘E — Three Mainland visitors have filed suit in Fifth Circuit Court over injuries related to a car crash earlier this year on Kaua‘i.
John D. Yamane, an attorney with Leavitt, Yamane & Soldner representing Allison Weber of St. Paul, Minn., and Terrance and Diane Weber of Grand Rapids, Mich., filed a motor vehicle tort case on Sept. 17.
The three are suing Kenneth I. Firestone, of Kaua‘i, along with Kaua‘i Auto Sales, Garden Island Auto Sales, Inc. The Webers were visitors on Kaua‘i earlier this year. On Feb. 16, the three were traveling eastbound on Kaumuali‘i Highway, when Firestone was traveling westbound and crossed the center line and struck the Webers’ vehicle head on.
The suit alleges that Firestone operated his vehicle in a negligent manner and that it was a factor in the three suffering permanent injuries. Terrance and Diane have suffered a loss of consortium as a result of their injuries.
The personal injury protection benefits incurred by the Weber medical and therapeutic expenses and other damages exceed $5,000. Firestone was driving in the course of his duties for Kaua‘i Auto Sales and a claim that the company is vicariously liable is also alleged.
