LIHU‘E — A Kapa‘a man was sentenced to probation in two separate domestic violence cases heard in two courts last week.
Joseph Anthony Palazzolo, 74, of Kapa‘a was handed two concurrent sentences of probation on family abuse and terroristic threat charges in 5th Circuit Court.
One issue was with the defendant already serving 74 days prior to his change of plea when the mandatory minimum at sentencing is two days in jail.
The jail time applied to the two arrests on separate charges, and Palazzolo was sentenced to time served in both cases. The state recommended the sentence and probation.
Palazzolo was arrested June 22 on second-degree terroristic threat and family abuse charges, and again on July 22 for second degree terrorist threat and family abuse.
The plea deal reduced the charges to misdemeanors
On Wednesday before Judge Kathleen Watanabe, deputy public defender Stephanie Sato said these were first-time arrests for Palazzolo.
Watanabe ordered anger management classes, added a $250 fine to the sentence and ordered domestic violence intervention until he could be clinically discharged. She also added a substance abuse assessment and counseling.
On Thursday, Chief Judge Randal Valenciano sentenced Palazzolo to two years’ probation and to jail for time already served for intentional choking and for a second-degree terroristic threat. The incident reportedly involved another individual and took place in public.
The prosecutor read the indictment to note that Palazzolo reportedly struck the female victim in the arms and chest before the choking incident.
Valenciano also ordered domestic violence courses and a substance abuse assessment.
