LIHU‘E — Luana Leimomi Alapai, 26, of Kapa‘a, was sentenced to time served Thursday, with one year’s probation for a third-degree theft charge.
Chief Judge Randal Valenciano of the 5th Circuit cautioned the defendant regarding a criminal history that includes seven convictions. Although all for misdemeanor or lower offenses, the judge said sentencing in the future, including a violation of probation, would be more severe.
Alapai entered a guilty plea to third-degree theft on Feb. 6. Although probation was a risk when considering Alapai’s record, Valenciano said he granted it in this matter, in part because of the defendant’s reported jail time in excess of 58 days.
Defense counsel Rosa Flores said Alapai committed a foolish act as the result of a failed relationship.
“I am sorry for the foolish act that I did, and I am trying to get my life back on track,” Alapai said in her statement to the court.
County Deputy Prosecuting Attorney Jared Auna represented the state. Following a bench conference with an appearance by the original prosecutor, the state recommended time served with probation to include appropriate drug assessments and counseling.
