LIHU‘E — A Fifth Circuit Court judge ordered a fitness for trial examination of a defendant accused of damaging store windows and an ATM at Kukui Grove Center in December.
At a Tuesday hearing Judge Kathleen Watanabe granted the three-panel fitness examination for Patricia Lewis, 31, of Lihu‘e. The defendant was not present in court and her presence was waived for the proceedings at the request of State Deputy Public Defender Samuel Jajich.
Lewis was arrested Dec. 27 and is facing amended charges of second-degree criminal property damage, a class C felony; third-degree criminal property damage, a misdemeanor; and attempted first-degree criminal property damage, a class B felony.
Second Deputy Prosecuting Attorney Rebecca Vogt said the state would not object to the fitness motion. The court set a status hearing on the results of the three reports on Feb. 26.
Lewis remains held in custody on $15,000 bail. Her scheduled trial date is for May 28.
