LIHU‘E — Following a stipulated fact trial, a Kapa‘a man was found guilty on count of methamphetamine possession Thursday in 5th Circuit Court.
Frank Gilbert Bukoski Jr., 40, faced the stipulated trial, based on facts and decided by the judge agreement, after the state’s motion to terminate Bukoski from Drug Court was granted on Oct. 10. He had been in the program since Dec. 30, 2010.
Chief Judge Randal Valenciano listened to arguments and found the defendant guilty of third-degree promotion of a dangerous drug. However, he found him not guilty of unlawful use of drug paraphernalia, another felony charge.
The judge asked the prosecution for a specific description of the paraphernalia. It was lacking in the report, and with no further evidence of the paraphernalia, the charge was dropped.
County Deputy Prosecuting Attorney Jared Auna represented the state.
The court granted State Deputy Public Defender Christian Enright’s request for a new diagnostic report that would more accurately assist in sentencing now that the second felony charge was dropped.
Bukoski was arrested for the charge on Nov. 22, 2010.
Sentencing is scheduled for Feb. 21, 2013. There is a possibility of a five-year prison sentence and a $10,000 fine for a class C felony.
