LIHU‘E — The sentencing of Dr. Harold “Tex” Spear III on state charges was delayed again, awaiting results in U.S. District Court.
Spear was to be sentenced Wednesday in 5th Circuit Court in anticipation of a federal sentencing phase conclusion by Feb. 21. The sentencing in both matters has moved back.
Sentencing with U.S. District Court Judge David Ezra is set for today, according to spokesperson Joshua Wisch. This sentencing in 5th Circuit was rescheduled for March 7, where Judge Kathleen Watanabe will preside.
Spear faces a possible 20-year prison sentence and $1 million in fines on federal charges of illegally dispensing Schedule III controlled medications in Alabama in 2008. He faces state sentencing in two cases of illegally dispensing Schedule II medications.
The state case was delayed as the federal case went through a five-year process.
