LIHU‘E — A 26 year-old Kapa‘a woman lost her probation and was re-sentenced to a five-year jail term Thursday in 5th Circuit Court.
Defense attorney Charles Foster described Shauday Pulelehua Ragudo as someone who did not turn to drugs, but was raised in an environment where using illegal drugs was part of everyday life.
Foster said Ragudo has been in and out of various treatment programs and needs more help.
Ragudo returned to court in November on a bench warrant for violating her probation granted in March 2010 with a drug arrest and contempt of court charges.
Chief Judge Randal Valenciano of the 5th Circuit granted the state’s motion for revocation of probation in January, and a re-sentencing hearing was scheduled for the probation charges and new drug charges stemming from a November arrest.
The judge denied Foster’s request for a 30-day continuance.
The original sentence for third-degree dangerous drug use and illegal use of drug paraphernalia resulted in five years’ probation.
Valenciano on Thursday sentenced Ragudo to concurrent terms on all counts totaling five years in jail with credit for time already served.
