LIHU‘E — Fifth Circuit Chief Judge Randal Valenciano set bail at $20,000 for a Kapa‘a resident indicted of repeated domestic violence.
Calvin Roy Gonsalves, 39, was arrested Oct. 5. He had been released on bail until the Nov. 4 indictment hearing.
County Second Prosecuting Attorney Samuel Jajich represented the state. The indictment noted that Gonsalves is accused of two counts of Class C Felony Family or household member abuse. The alleged incident occurred on Oct. 5, when the victim claims that Gonsalves physically abused her by intentionally applying pressure to the throat and impeding the normal breathing or circulation of the blood.
The victim petitioned for a temporary restraining order on Oct. 28.
Gonsalves has two previous convictions for similar offenses. He pleaded no contest and received two years probation for family or household member abuse and violation of a temporary restraining order on Jan. 18. The sentence required a domestic violence intervention program and a substance abuse evaluation. He was sentenced to the same probation for intimidating a witness related to the crime on Jan. 12.
A petition for a restraining order against Gonsalves by another individual was dismissed on Nov. 2, 2009.
The spouse of Gonsalves petitioned and received a temporary restraining order against Gonsalves on Dec. 30, 2008. He was arrested the same day for violating the order.
A divorce petition was filed by the victim on Jan. 13, 2009 but was not pursued. A request to dissolve the order by the victim was granted on Oct. 8, 2009.
Gonsalves pleaded no contest and received six months probation for fourth-degree theft and fourth-degree criminal property damage on Nov. 26, 1996.
Deputy Public Defender Christian Enright represented Gonsalves at the arraignment. He entered a plea of not guilty on his client’s behalf.
Valenciano set the trial date for March 12.
