LIHU‘E — Brock-Alan Reyes, 18, of Kapa‘a, who was 17 when he was arrested on attempted murder, weapons and ammunition charges in connection with a drive-by shooting at the Waipouli Town Center McDonald’s restaurant in June 2008, recently appeared in court before Judge Randal Valenciano.
Valenciano said an April 2009 motion to dismiss charges and remand the case to Family Court remains on the table, with Dan Hempey, the attorney representing Reyes, arguing that since Reyes was a minor at the time of his arrest Family Court is the proper venue.
John Murphy, county deputy prosecuting attorney, was given until the close of business Friday by Valenciano to file a memo either in opposition to Hempey’s motion or agreeing with Hempey, and said he will discuss the case with Hempey.
Hempey has until the end of the business day Feb. 1 to file a reply, and Valenciano set a hearing on the matter for Feb. 11 at 8 a.m.
Taekyu U, 27, of Kapa‘a, was sentenced Dec. 31 to 20 years in prison after pleading guilty in a plea agreement to a reduced charge of reckless endangering and weapons charges similar to charges Reyes faces.
U said at his sentencing that he was the shooter and Reyes drove the car and had no knowledge of U’s intent on the night in question.
