Drug charges against Dylan B. Hooser, 21, state Sen. Gary Hooser’s son, were dropped yesterday in Hanalei District Court.
The case was dismissed after Hooser’s lawyer, Dan Hempey, filed a motion to suppress evidence, said Hempey after court. He said that the alleged evidence was obtained because of an anonymous tip, and that according to state law evidence obtained solely through an anonymous tip is inadmissible.
The motion was granted by Circuit Court Judge Trudy Senda, and because of lack of evidence the charges were dismissed. Hooser was arrested on charges of third-degree promotion of a detrimental drug, possession of less than an ounce of marijuana, a petty misdemeanor, on December 11 of last year in the Ching Young Village parking lot in Hanalei, according to Kaua‘i Police Department sources.
