LIHUE — The already-heated Coco Palms case got moreso today when a bailiff tried to physically carry a woman, screaming, from the courtroom of District Court Judge Michael Soong.
The tense situation came about when two people were ordered to be removed from the courtroom during this morning’s civil proceedings about Coco Palms.
But after a short recess, they returned to the courtroom, where there was a dispute over the man’s cell phone, which had been confiscated. He was ordered to leave without the phone, but his mother verbally objected.
The bailiff tried to pick up the woman, dropped her, then ordered the courtroom to be cleared as the woman sat in the far corner of the courtroom.
The case took a recess and was scheduled to resume at 1:30 p.m.
At stake, Soong is hearing arguments in a contested court case between a developer who claims ownership of the famed Coco Palms Resort in Wailua and is planning a $175 million resort development, and a group of Native Hawaiians who say they have historical and genealogical rights to the land they’ve been occupying for nearly a year.
Go Debbie I hope you stop this development. there is no reason for it. Turn that into a historical park for the people of Kauai.

Bunch of clowns. A courtroom bailiff has the same authority as a deputy. Break the rules of the courtroom pay the price. This altercation happened while court was still in recess. The judge had not resumed the proceedings.

If Noa and them would just section 106 this land like Uncle says, then by law the Navy has to protect them and there is no court. No one can be touched at that point.
Who are these trespassers? Do they have jobs? Do they have proof they are Hawaiian? Where were they when Coco Palms was being built the first time? Why didn’t anyone complain then? Sound like a bunch of deadbeats trying to get a free lunch.
Outrageous the behavior of this Public Servant! You would think someone in that position in a courtroom would know the LAW. A woman officer is required first and foremost before any physical confrontation with any female. This law has been in effect for decades! There is NO excuse for this man’s behavior!

This kind of corporate colonialism really has some people just bowing down, and others like — wait a second did you just drop a tutu while you were trying to take indigenous peoples’ land rights? This developer is unlikely to be successful with the project when tenacious Hawaiians and honest Americans refuse to support or endorse it, and are willing to occupy the land to protect and uphold it for their future generations. This is 2017. Unless this developer wants several thousand very frank reviews on every Yelp, Trip Advisor and travel review site about this proposed hotel, and protests outside the building, and to prosecute indigenous people for guarding their land, or have visitors informed on arrival at the airport, locals willing to boycott service provision, drivers who refuse to bring visitors onto the property, I can’t imagine even if it were built, that it wouldn’t be fraught with serious PR problems. You can whitewash it all you want but Kauai is a small island, so if you screw the locals it won’t go unnoticed. I would not want to have anything to do with this developer or this hotel.
News reports that the lady claimed to be sitting in front of her son, yet the video shows the bailiff trying to remove her from the last bench. Plus, if she refused to leave after the bailiff asked her to leave, he has all right to forcefully remove if necessary.
These squatters need to be moved off the site. The have made the property into a trash heap attracting cats, rats & other critters which are not healthy for human habitation. The consumption of drugs in their camp is rampant & many of the inhabitants have resorted to petty theft from properties & vehicles in nearby communities. Besides, they don’t have legal title to the property even as a registered owner. Time to bulldoze them off & repurpose the land for a better use!
Sadly, Debra Kekaualua always tries to make it about herself. She doesn’t nothing but shed a bad light on the cause the Native Hawaiians are espousing.
